LEGAL NOTICE – USE OF PRODUCTS AND LIABILITY

The client is responsible for complying with current laws and regulations, as well as the rules applicable to the use made of the products and applications. However, the use of Persianas Roma products is prohibited when it contravenes good faith, public order, current legislation, and, in particular, the following non-exhaustive cases:

• Use that is contrary to Spanish law or that infringes the rights of third parties.

• The publication or transmission of any content that is violent, obscene, abusive, illegal, xenophobic, or defamatory.

• Tampering with or fraudulently interfering with the personal websites, emails, or systems of other users or third parties without their authorisation.

• Sharing of cracks, software serial numbers, or any other content that infringes third-party intellectual property rights.

• Collecting and/or using personal data of other users without their express consent or in violation of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).

• Use of the domain’s mail server and email addresses for spam, mail bombing, phishing, escrow fraud, 419 scams, pharming, virus dissemination (trojans, worms, etc.), or any other activity of a sabotaging, fraudulent, or criminal nature.

The client and/or the domain name holder guarantees Persianas Roma that the product chosen is not contracted for unlawful purposes nor does it infringe intellectual or industrial property rights, or any other legitimate rights and interests of third parties.

The client agrees to keep the email address provided in the contract form active, operational, and up to date for communications with Persianas Roma, as this is the preferred communication method.

The client is solely responsible for the use and safekeeping of the login credentials and passwords provided by Persianas Roma for the use of the tools provided to manage the contracted products. These credentials serve as necessary identifiers allowing Persianas Roma to verify the client’s access and grant authorisation to perform requested actions. Any use or sharing of these identifiers, including with third parties, is the sole responsibility of the client.

The client bears full responsibility for the content of their website, transmitted and stored information, linked hypertext, third-party claims, and legal actions arising from references to intellectual and industrial property, personal rights, and child protection.

Accessing, modifying, or viewing the configuration, structure, or files of Persianas Roma’s servers is strictly prohibited. Any damage caused to the servers or security systems of Persianas Roma due to the client’s negligent actions will result in civil and criminal liability.

The client will adhere to the technical standards set by Persianas Roma for the administration and development of contracted products, avoiding abusive use that may slow down servers or impair product performance or the rights of other clients.

Users contracting through the website http://www.persianasroma.es confirm that they are of legal age. Contracts entered into by minors require prior authorisation from their parents, guardians, or legal representatives, who will be held responsible for contracts made by minors under their care. It is the responsibility of the minor to obtain the necessary consent to contract.

COMMITMENTS

NO MISLEADING ADVERTISING

Persianas Roma undertakes not to engage in misleading advertising. For this purpose, formal or numerical errors found within the website’s various sections shall not be considered misleading advertising, as they may result from incomplete or defective maintenance and/or updating of the information contained therein. Persianas Roma commits to correcting such errors as soon as they become aware of them.

NO SENDING OF UNIDENTIFIED COMMERCIAL COMMUNICATIONS

In accordance with Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE), Persianas Roma undertakes not to send advertising or promotional communications via email or other equivalent electronic means without clearly identifying them as commercial communications and without prior request or express consent from the recipients.

For these purposes, any information sent to Persianas Roma clients that aims to maintain the existing contractual relationship, provide information, training, or other activities related to the contracted service shall not be considered a commercial communication.

Clients may revoke their consent for promotional data processing directly, easily, and free of charge via their Client Area.

LIABILITIES

Persianas Roma shall not be held liable for any damages, of any kind, that may result from the use of the information, materials contained on this website, or the included software. Links and hypertext enabling access to third-party services and features via http://www.persianasroma.es do not belong to Persianas Roma and are not under its control.

Persianas Roma is not liable for any use made by users of the services, contents, links, and hypertext available on http://www.persianasroma.es.

Persianas Roma is not responsible for the unlawful use by unauthorised third parties of brand names, product names, or trademarks not owned by the company but which appear on http://www.persianasroma.es. Nor is it responsible for the integrity, accuracy, or legality of content found on linked websites.

Persianas Roma accepts no liability for viruses originating from telematic transmissions infiltrated by third parties (e.g. word processor macros, Java applets, ActiveX programs), generated to negatively affect a computer system.

Persianas Roma stores an electronic copy of the email sent to the client, which includes the personalised product contract upon completion of the purchase.

All intellectual and industrial property rights are expressly reserved by Persianas Roma. The source code, graphic designs, images, photographs, sounds, animations, software, texts, domain names, trademarks, as well as all information and content on the website are protected under Spanish law in favour of Persianas Roma.

Total or partial reproduction, publication, processing, distribution, dissemination, modification, transformation, or decompilation of any of this material without prior written consent is not permitted. Users may only use materials on this website for personal and private purposes. Any commercial or other use is prohibited.

Persianas Roma will ensure compliance with these conditions and the proper use of its intellectual and industrial property, taking all appropriate legal action.
